Is Your Business Compliant?
Consent for Text/SMS Verification. In the United States, under the federal Telephone Consumer Protection Act, you need your customer’s “prior express consent” to automatically send text messages to them.
Requests for Information. Businesses will soon have to provide California customers with a copy of their personal information held by the business, and “reasonably verify” that the request is from the customer.
Age Verification. In many states, online sellers of age restricted products — like liquor, tobacco and vaping products, and gambling services — must check the buyer’s government-issued photo ID, or in some cases at least verify the buyer’s information against consumer databases, to ensure that the buyer is old enough.
Requests to Delete. Businesses will soon have to comply with requests from California customers to delete their information, and “reasonably verify” that the request is from the customer.
“Behind the Scenes” Verification. In Canada, it is illegal to identify individuals without their knowledge and consent.
E-Commerce Verification. Online retailers doing business with European Union (EU) residents must comply with the EU’s new Payment Services Directive 2 (PSD2) law. The new EU directive requires customer authentication – such as by email or text/SMS code sent to the customer’s cell phone – for most transactions over 30 Euro.
Right to Access Information. Businesses have to comply with requests from EU customers for a copy of their personal information held by the business, and verify that the request is from the customer.
“Behind the Scenes” Verification. Under the European Union’s General Data Protection Regulation (GDPR), it is illegal to process a customer’s identification information without prior consent that is “freely given, specific, informed and unambiguous“.
Right to Be Forgotten. Businesses must comply with requests from EU customers to delete their information, and verify that the request is from the customer.
